The Program

The Process
All parties must be interested in collaboration in order to take advantage of the benefits of Smartsettle. Parties begin with an orientation and review of the rules of conduct and are given codes to access the program. In a combination of online and face-to-face meetings, one or more facilitators assist the parties in modeling the problem and representing their confidential preferences with respect to the various issues to be resolved. Packages to be considered for an agreement can then be created and rated according to the preferences of each party. After bargaining ranges are created by parties exchanging optimistic proposals, the Smartsettle neutral site can generate suggestions for agreement within those ranges. A binding tentative agreement is reached when two parties accept the same package. Parties may ask Smartsettle to look for improvements to a tentative agreement before finalizing it.
